(Amended Plans received 09.06.2022) This is an application to establish whether the development is lawful. This will be a legal decision where the planning merits of the proposed use cannot be taken into account. (LDC).

Minutes of the PLANNING COMMITTEE Meeting held on Monday 20 June 2022 at 7.30pm in the Parish Centre, Adastra Park, Hassocks

Attendees: Parish Councillors: Carolyn Barton, Bob Brewer, Bill Hatton and Claire Tester.

P22/12 APOLOGIES FOR ABSENCE. Cllrs Carolyn Barton and Kristian Berggreen.

P22/13 DECLARATIONS OF INTEREST. Cllr Claire Tester declared a non-pecuniary interest in item 5.7 SDNP/22/02690/FUL Land to The rear of 19 Beacon Hurst Hassocks West Sussex. Erection of an agricultural feed and machinery store.

P22/14 MINUTES.

It was noted that Cllr Carolyn Barton was incorrectly included in the list of attendees and therefore the Committee approved her name being crossed out.

It was RESOLVED that, subject to the amendment agreed above, the minutes of the meeting held on 30 May 2022 be signed by the Chair as a true and accurate record of the meeting.

P22/15 PUBLIC PARTICIPATION. None

P22/16 APPLICATIONS

DM/22/1610 28 Kings Drive Hassocks West Sussex BN6 8DZ Replacement of conservatory with single storey rear extension. (LDC). Response: NOTED

DM/22/1700 Milton Cottage Keymer Road Hassocks West Sussex BN6 8QS Demolition of existing rear extension and conservatory and replacement with single-storey rear extension and first-floor bay window. Response: RECOMMEND APPROVAL. The applicant is advised that Government has committed to adopt a ‘Future Buildings Standard’ during 2021 which will change the Building Regulations requirements for alterations and extensions to homes to bring these alterations closer to that of a ‘zero energy building’.  This is supported by Policy 5 ‘Enabling Zero Carbon’ of the Hassocks Neighbourhood Plan which states that proposals that modify existing buildings (including extensions) should seek to maximise the inclusion of energy-saving measures and renewable energy generation.  Energy saving measures include floor, roof and wall insulation, and low u-value windows (which may need to be triple glazed).  These requirements may require amendments to your design which could affect the drawings submitted for planning permission. The applicant may wish to note that alterations that are built to a Nearly Zero Energy standard, are unlikely to need further retrofitting to minimise the carbon emissions that the nation is required to reduce to zero by 2050.  As retrofitting an existing home to be highly energy efficient is more complex than doing so for a new building, applicants may wish to look at the ‘EnerPHit’ standard that the Government is understood to be considering as the applicable “Nearly Zero Energy’ standard in this context, or at the Architypes published by the London Energy Transformation Initiative for u-values for your extension walls, windows etc. and for ventilation and overheating prevention standards to be achieved.

DM/22/1668 1 Hurst Road Hassocks West Sussex BN6 9NJ Proposed new four bedroom house on land adjacent to existing house. Response: RECOMMEND REFUSAL.  This application is on a site which is outside of the built-up area as defined within the Mid Sussex District Plan, and as such is contrary to Hassocks Neighbourhood Plan Policy 14 – Residential Development within and adjoining the Built Up Area Boundary of Hassocks.  This policy states that development proposals for residential development outside of the built up area of Hassocks will be supported where they are in accordance with Policy DP6 of the Mid Sussex District Plan and Policy 1, Local Gaps, of the Hassocks Neighbourhood Plan.

MSDP Policy 6 Settlement Hierarchy states that outside of the defined built-up area boundaries, the expansion of settlements will be supported where the site is allocated in the District Plan or a Neighbourhood Plan.  This site is not allocated in either.  Furthermore a new dwelling on this site would be contrary to District Plan policies DP12 Protection and Enhancement of Countryside and DP15, New Homes in the Countryside.

The location of this site is also directly in a designated Air Quality Management Area.  The building of a new dwelling in such an area presents a potential risk to the health and wellbeing of the future occupants and therefore the Council cannot support such a proposal.

Additionally, the design of the property represents overdevelopment of the site and does not respect the scale and character of the surrounding building and landscapes and is therefore contrary to policies DP26 of the District Plan and Policy 9 of the Hassocks Neighbourhood Plan; Character and Design.

DM/22/1781 68 Church Mead Hassocks West Sussex BN6 8BW Proposed garden room. This is an application to establish whether the development is lawful. This will be a legal decision where the planning merits of the proposed use cannot be taken into account. (LDC). Response: NOTED

DM/22/1798 68 Church Mead Hassocks West Sussex BN6 8BW Proposed side dormer. Response: RECOMMEND REFUSAL. This application would result in a loss of privacy to the neighbouring property and is therefore contrary to Character and Design; HNP Policy 9 and MSDP Policy DP26.

DM/22/1467 26 Dale Avenue Hassocks West Sussex BN6 8LP Replace existing conservatory with a new single storey rear extension and convert loft including hip to gable roof extension. (Amended Plans received 09.06.2022) This is an application to establish whether the development is lawful. This will be a legal decision where the planning merits of the proposed use cannot be taken into account. (LDC). Response: NOTED

SDNP/22/02690/FUL Land to The rear of 19 Beacon Hurst Hassocks West Sussex. Erection of an agricultural feed and machinery store. Response: RECOMMEND REFUSAL. This proposal represents a new building in the countryside which is not justified by the agricultural needs of this small field and is therefore contrary to Policy SD39 of the South Downs Local Plan.  It also appears to propose a partially domestic use which would extend the residential use of 19 Beaconhurst into the field outside of its residential curtilage.  It is considered that any ancillary residential buildings should be contained within the garden of 19 Beaconhurst.
